Workshop on Commercial agency law and the new competition law assessment of commercial agency and distributor agreements.

 

The General Competition Authority (GAC) continuous to expand their authority. In a recent development GAC was granted authority to review commercial agencies and distributorship from a competition perspective.

They may consider market impacts of arrangements between principals and their distribution partners and void exclusivity arrangements. These new authorities make the Saudi antitrust regime and GAC increasingly relevant not only for global corporates invested in the Kingdom but also for SMEs and companies exporting to Saudi Arabia.

Companies must act now to revise their distributor and agency arrangements and install compliance mechanisms to shield themselves from substantial fines and other penalties.
